RULES
- OBJECTIVE: The Western Culture Conservancy (WCC) is a 501(c)(3) non-profit organization whose mission is to promote, protect and preserve the uniquely historic cultural heritage of the western United States. The WCC recognizes that, in a large part of the west, it was the vast rich mineral deposits (primarily gold), that brought the first settlers and civilization to this area. The California Gold Rush of 1849 and the Oregon Gold Rush in 1852, which together brought 100’s of thousands from all over the Earth to the west are prime examples of the importance of the cultural heritage of mining in this region.
Presently,
the WCC believes the living cultural heritage of the individual
prospector and miner is threatened with extinction by the very states
(CA & OR) that were first settled primarily by individual miners
by passing legislation that bans the use of all practical means to
extract gold from instream placer deposits.
The
WCC, being based in Oregon; has recognized that Oregon’s Senate
Bill 838 (passed in 2013), and it’s 5-year moratorium (beginning
January 2, 2016) on the use of “any
motorized placer mining equipment”
in Essential Salmon Habitat (ESH) streams poses a direct,
unacceptable, and unlawful threat to prospectors and miners
throughout Oregon -- and must be challenged.
To
this end, the WCC is sponsoring a fund-raising event in the form of a
series of two raffle drawings for the support of the challenge
against SB 838 now in the United States 9th
Circuit Court of Appeals brought by the Galice and Waldo Mining
Districts; and to help fund the on-going challenge filed by the
Eastern Oregon Mining Association and the Waldo Mining District, now
in the Oregon Supreme Court against the unlawful 700PM suction dredge
permit issued by DEQ.
All
proceeds from this series of drawings will be used solely to help
fund the on-going litigation efforts against SB 838 and the Oregon
DEQ’s “In-Stream Mining General
NPDES Permit 700PM”. (See Item #19
for more information).
2.
THE DRAWINGS: The
WCC will be holding a Preliminary
Drawing on Dec. 2, 2016, and the
Final Drawing
for the “1/2 Lb. of Gold” on June 2, 2017.
All
entries (including winning coupons) in the Preliminary Drawing will
be eligible to win in the Final Drawing for the 1/2 Lb. of Gold.
PRELIMINARY
DRAWING: The Preliminary Drawing
will be held at a joint meeting of the Galice & Waldo Mining
Districts beginning at 6:00 pm on Friday, December 2, 2016, at the
Redwood Grange, Grants Pass, Oregon (need
not be present to win).
FINAL
DRAWING: The Final Drawing for
the 1/2 POUND OF GOLD will be held at a joint meeting of the Galice &
Waldo Mining Districts beginning at 6:00 pm on Friday, June 2, 2017,
at the Redwood Grange, Grants Pass, Oregon (need
not be present to win).
NOTE:
In the event that the joint meetings cannot be held at the Redwood
Grange on the dates specified above the Drawings will be held by the
WCC at a public location in Grants Pass (to be disclosed) with at
least eight (8) witnesses present.

HOW TO ENTER:
“Official
Entry Coupons”
are available at the Armadillo Mining Shop in Grants Pass, Oregon, at
other business locations, mining organizations’ newsletters, etc.,
or can be downloaded and printed from the Western Culture Conservancy

Upon
arrival, your entries will be transferred to the matching number of
Official Coupons by dedicated WCC staff and placed in the drawing

NOTE that there is no entry “stub”. Entry Coupons identify the
participant. Your canceled check serves as receipt for your entries.

(NOTE:
Using and affixing mailing labels on the back of the Entry Coupon is
allowed, provided such labels are securely attached to the coupon
(taping them on is OK), and that such labels include Name, Address,
and other required information. (Note: If such a mailing label
falls off of your coupon that coupon will be disqualified).)
4.
ENTRY FEE: $5.00 per
Entry, or multiples of Six (6) Entries for $25.00
(must be made at the same time), or
any combination thereof. There is no limit to the number of Entries
an individual can make, or on how often they enter.

5.
WHO CAN ENTER: Any
citizen or legal immigrant of the United States of America over the
age of 18 years (at the time of Entry) is eligible to enter.
6.
WHO CAN WIN: Anyone
that qualifies (see Item #’s 3, 4 & 5 above) and has legibly
printed on the entry coupon (or supplied by letter) their name, age,
and at least one (1) of the following: Mailing Address, Phone
Number, and/or Email Address) may win, with the exception of the
individual drawing any particular coupon may not draw their own
coupon, or the coupon of an immediate family member (see Item #10
below).
Illegible
or otherwise questionable coupons (see Item #3 above) will be
examined by a panel of at least four (4) judges. If none of the
judges can determine the winner (due to illegible printing,
incomplete information, etc.), said coupon will be declared
ineligible and discarded, and another coupon will be drawn.

NOTE: The
Drawing of winning coupons shall be made by members of the WCC, GMD,

PRIZE LIST: Each
Drawing will include Consolation Prizes, 1st

11.
WINNERS WILL BE DETERMINED:
By random drawing from all the entries, in the following order:
A.
“CONSOLATION” PRIZES (valued
up to $99.99):
One
(1) entry coupon will be randomly drawn for each of the “Consolation
Prizes”, starting with the lowest
ranked4
consolation prize working to the highest ranked consolation prize.
B.
“PLACE” AND “GRAND PRIZES” (valued
at $100.00 +):
Upon
completion of the drawing for the Consolation Prizes, one (1) entry
coupon will be randomly drawn for each of the “Place
Prizes”, starting with the lowest
ranked Place Prize working to the highest (1st)
ranked Place Prize, followed by the drawing for the Grand Prize.
NOTE:
Winning coupons in the Preliminary Drawing will not
be eligible for any of the other prizes during the Preliminary
Drawing -- but will be returned to the entry drum and will be
eligible to win in the Final Drawing.
There
is no limit to the number of Prizes an individual may win; however, a
single winning coupon may win only one (1) prize during the Drawing
it was drawn in.
12.
NOTIFICATION OF WINNERS: The name of the winner
shall be announced at the drawing as the winning coupon is drawn for
each particular prize.5
In the event that the winner is not present at the time of the
drawing and:
- A phone number has been provided, WCC/GMD/WMD will attempt to contact and congratulate the winner during or immediately after the drawing; and/or
- If the winner provided an email address, WCC/GMD/WMD will notify the winner within 7 days of the drawing.
- In the event that the winner(s) is not present at the drawing and has not provided a phone number or email address, or has not responded to either, WCC/GMD/WMD shall make at least one (1) attempt per week for at least three (3) weeks to contact the winner/s via U.S. Mail based on the contact information provided with the entry. The winner/s shall be given at least three (3) additional weeks to respond and claim their prize by contacting WCC/GMD/WMD. All unclaimed prizes shall become the property of WCC (see #’s 15 & 16 below).
Names of Prize Winners
will be posted on the WCC, GMD and WMD
websites within 7 days of the drawing.

13.
PRIZE DELIVERY: WCC (or prize donor) will cover
all costs or fees associated with the delivery of all of the prizes
to anyone within the United States (including Hawaii & Alaska).
Anyone wishing their prize shipped outside of the continental United
States must make arrangements with WCC and will be responsible for
all handling & shipping costs.
WCC will cover delivery
insurance on all prizes valued over $100.00. All prizes shall be
shipped via some form of verifiable delivery, such as Certified U.S.
Mail, UPS, or FedEx.
Anyone wishing priority
shipment must make arrangements with WCC, and pay any additional
handling, insurance, or shipping costs.
14.
ADDITIONAL FEES: It is the sole
responsibility of WCC to make each prize available, along with
covering the normal delivery costs at no additional cost (other than
the original Entry Fee) to the Prize Winner. Any and all additional
costs, such as but not limited to: Taxes, License Fees, Set-up
Fees/Dealer Prep, Back-Ground Check (if required), Insurance
(shipping and otherwise, etc. for prizes valued under $100.00) shall
be the sole responsibility of the Prize Winner.
15.
UNCLAIMED PRIZES: In the event that the specified
time limit to claim a prize (see #12(C) above) expires without WCC
being able to make contact with the winner, all unclaimed prizes
shall become the sole property of WCC and will be used as a prize at
a future date.
16.
INELIGIBLE WINNERS: In the event that a prize
winner is determined to be ineligible (i.e.; no ID, not of legal age,
giving false name or contact information, a non-legal resident, or
any other reason making the award of the prize to that individual an
unlawful act), that individual shall be determined, by WCC, to be
ineligible to win the prize, and the prize shall be the sole property
of WCC, which will be used as a prize at a future date.
17.
PRIZE WARRANTY INFORMATION: WCC, GMD, and WMD do
not warranty any of the prizes offered. Any warranty, if such
exists; or the exercise thereof; shall be solely between the winner
of the prize and the manufacturer and/or authorized dealer.

19.
LEFT OVER FUNDS: In the event that there are
left-over funds after the litigation against SB 838 and DEQ’s
unlawful 700PM permit is completed, any excess funds will be used by
the WCC for possible future litigation or to further promote,
protect, and preserve the rich Cultural Heritage of the West.
20.
DISCLAIMER: All specifications, claims and
information contained in these Official Rules, along with any
notices, flyers, announcements or other printed materials and all
forms of electronic or digital reproductions in connection with the
“WCC 1/2 Lb. of Gold Drawing” are based upon current
knowledge and printed material available at time of publication.
WCC, GMD & WMD assume no responsibility for any inaccuracies,
opinions or omissions.
Upon delivery of a prize,
WCC, GMD & WMD assumes no further responsibility what-so-ever for
the use, misuse, or any damage or harm to the prize, other property,
or individuals (including the prize winner).
21.
OFFICIAL RULES: These Official Rules are in
effect as of June 1, 2016, and may be amended due to unforeseen
circumstances beyond the control of WCC, GMD, or WMD up until the
time and date of the Drawing(s). In the event these rules must be
amended, Amended Official Rules shall be posted on the WCC, GMD and
WMD websites.
